1. Introduction

Faminga is committed to safeguarding your privacy and the protection of your personal data. This Privacy Policy explains how we collect, use, disclose, and store your personal information and your rights under the Law N° 058/2021 of 13/10/2021 relating to the Protection of Personal Data and Privacy in Rwanda.

By using our platform (www.faminga.app), you consent to the practices described in this Privacy Policy.

2. Definitions

For the purposes of this Privacy Policy:

  • Account: A unique profile created for you to access our services.
  • Company: Refers to Faminga, operated by Ihiga Ltd, located in Kigali, Rwanda.
  • Personal Data: Any information that identifies or can identify an individual.
  • Platform: The Faminga website or mobile application.
  • Service: Any functionality or service provided by Faminga.
  • Service Provider: A third party that processes personal data on behalf of the Company.
  • You / User: Any person accessing or using the Faminga platform.

3. Data We Collect

We may collect the following personal data:

  • Full name
  • Email address and phone number
  • Identification information (e.g., national ID, if required)
  • Contact details and address
  • Location-related information
  • Service usage data (e.g., activity logs)

We only collect the data necessary to deliver and improve our services, in accordance with your consent or legal requirements.

4. How We Collect Your Data

We collect data directly from you when you:

  • Create or manage your account
  • Submit requests or forms
  • Contact us for support or feedback
  • Use any part of our services

We may also collect data indirectly where permitted by law and with your prior consent.

5. Purpose of Data Collection

6. Marketing Communications

We send two kinds of marketing email: our public newsletter (farming tips, product updates, market insights and platform news), and, separately, occasional service-related or promotional email to holders of a Faminga account. Each is governed by its own legal basis:

  • Newsletter subscribers: on the basis of your consent, given through a double opt-in process — you must click a confirmation link sent to your address before we send you anything further.
  • Account holders: on the basis of our existing customer relationship with you, for communications reasonably related to the service you signed up for.

Every marketing email carries a one-click unsubscribe link that works immediately, without needing to log in. Clicking it stops all future marketing email to that address — we do not currently offer a preference centre to opt out of some categories while keeping others. We keep a record that an address has unsubscribed (or asked us to delete its data) specifically so that address does not get added back to the list later, including through a fresh newsletter signup unless you affirmatively resubscribe and confirm again.

This section does not cover transactional or service email — order confirmations, password resets, security and account notices, and similar messages we send because they are necessary to operate your account. Those are not affected by a marketing unsubscribe and cannot be opted out of while your account remains active.

7. Sharing of Data

We may share your personal data:

  • With authorized service providers who support our operations
  • With regulatory or legal authorities when required by law
  • With third parties, only with your consent or legal basis
  • In the event of a merger, sale, or reorganization of our company

We do not sell your data to third parties under any circumstance.

8. International Data Transfers

Where data needs to be transferred to service providers located outside Rwanda, we ensure that appropriate safeguards are in place to protect your data and comply with the law. You will be notified before any such transfer takes place, in compliance with Rwanda's data protection laws.

9. Data Retention

We retain your personal data only as long as necessary to:

  • Fulfill the purposes for which it was collected
  • Comply with legal, accounting, or regulatory requirements
  • Resolve disputes and enforce our agreements

When data is no longer needed, it will be securely deleted or anonymized in line with best practices.

  • Right to correct: You may ask us to update or correct any inaccurate data.
  • Right to delete: You can request deletion of your personal data, subject to legal requirements. Request account deletion
  • Right to object: You may object to the processing of your data under certain circumstances.
  • Right to withdraw consent: Where we process data based on your consent, you may withdraw it at any time.
  • Right to data portability: You can request a copy of your data in a commonly used format.

11. Children's Privacy

Our platform is not designed for use by individuals under the age of 18 without parental or guardian consent. We do not knowingly collect personal data from children. If we become aware that we have unknowingly collected data from a child, we will take steps to delete such data promptly.

Faminga takes security seriously and employs robust security measures to protect your personal data from unauthorized access, alteration, disclosure, or destruction. These include:

  • Encryption of sensitive data
  • Secure access controls and authentication mechanisms
  • Regular security audits and vulnerability testing

However, please note that no method of data transmission over the internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
